ONLINE STORE TERMS AND CONDITIONS

The owner of the online store skishop.ee (hereinafter Online Store) is Suusakeskuste AS (registration code 10211494), located at Valga County, Otepää Rural Municipality, Arula village, Kuutsemäe, 67301.

Validity of the sales contract, product and pricing information

The terms of sale apply to purchases of goods from the Online Store.

The prices of the products sold in the Online Store are indicated next to the products. A fee for the delivery of the goods is added to the price. All prices for goods sold in the Online Store are in euros.

The delivery fee depends on the location of the buyer and the method of delivery. The delivery fee is displayed to the buyer when placing the order.

Information about the goods is provided in the Online Store directly next to the goods.


Placing an order

To order goods, you must add the desired products to the shopping basket. To place an order, fill in the required data fields and select the suitable delivery method. The total cost, which can be paid securely via the following payment methods, is then displayed on the screen:

  • Estonian bank payments
  • Finnish bank payments
  • Latvian bank payments
  • Lithuanian bank payments
  • Visa/Mastercard card payments
  • Apple Pay and Google Pay

NB! When paying with a bank link, be sure to click the "Return to merchant" button on the bank's page.

Payments are processed by Maksekeskus AS. Payment takes place outside the Online Store in a secure environment – in the secure environment of the respective bank when paying via bank link, and in the secure environment of Maksekeskus AS when paying by credit card. The seller does not have access to the customer's bank and credit card details. The contract enters into force upon receipt of the amount payable to the Online Store's current account.

The owner of the Online Store is the controller of personal data and transmits the personal data necessary for making payments to the authorized processor Maksekeskus AS.

If it is not possible to deliver the ordered goods due to stock-outs or other reasons, the buyer will be informed of this at the earliest opportunity and the money paid (including delivery costs) will be refunded immediately, but no later than 14 days after sending the notification.


Delivery

Goods are shipped to the following countries: Estonia, Latvia, Lithuania, Finland

To receive the goods, the buyer has the following options: OMNIVA, ITELLA SMARTPOST parcel terminals, or by courier to the specified address.

The shipping costs are borne by the buyer, and the corresponding price information is displayed next to the shipping method.

Shipments within Estonia generally reach the destination specified by the buyer within 3 working days from the entry into force of the sales contract. Deliveries outside Estonia take place within 5 calendar days.

In exceptional cases, there is the right to deliver the goods within up to 45 calendar days.


Right of withdrawal

After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-store within 14 days.

The right of withdrawal does not apply if the buyer is a legal entity.

To exercise the 14-day return right, the ordered goods must not be used in any other way than is necessary to verify the nature, characteristics, and functioning of the goods in the way that is permitted for testing the goods in a physical store.

If the goods have been used for purposes other than what is necessary to verify the nature, characteristics, and functioning of the goods, or if there are signs of use or wear, the Online Store has the right to lower the amount to be refunded in accordance with the decrease in the value of the goods.

To return the goods, you must submit a declaration of withdrawal from the purchase of the goods, the form for which can be found here:

and send it to the email address info@skishop.ee no later than 14 days after receiving the goods.

The costs of returning the goods are borne by the buyer, unless the reason for the return is that the product to be returned does not correspond to the order (e.g., a wrong or defective product).

The buyer must return the goods within 14 days of submitting the declaration or provide evidence that they have handed the goods over to the carrier within the aforementioned period.

Upon receipt of the returned goods, the Online Store shall immediately, but no later than 14 days after receiving the withdrawal notice, refund to the buyer all fees received from the buyer under the contract.

The Online Store may refuse to make refunds until it has received the object of the contract back or until the buyer has provided evidence that they have sent the object back, whichever happens first.

If the buyer has explicitly chosen a delivery method other than the cheapest standard delivery method offered by the Online Store, the Online Store does not have to refund the cost exceeding the cost of the standard delivery method.

The Online Store has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if the price of the goods in the Online Store has been indicated significantly below the market price of the goods due to an error.


Right of complaint

The Online Store is responsible for the non-compliance with the contract terms or defects of the goods sold to the buyer that existed at the moment of delivery and which appear within two years from the delivery of the goods to the buyer. Within the first year from the delivery of the item to the buyer, it is presumed that the defect already existed at the time of delivery. It is the Online Store's obligation to refute such a presumption.

In the event of a defect, the buyer has the right to contact the online store within two months at the latest by sending an email to info@skishop.ee or by calling +372 5151005.

The Online Store is not responsible for defects that have arisen after the delivery of the goods to the buyer.

If goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund all fees associated with the sales contract to the buyer.

The Online Store will respond to the consumer's complaint in writing or in a form that allows written reproduction within 15 days.


Direct marketing and processing of personal data

The Online Store uses the personal data entered by the buyer only for processing the order and sending the goods to the buyer. The Online Store transmits personal data to the transport service provider in order to deliver the goods.

The Online Store sends newsletters and offers to the buyer's email address only if the buyer has expressed a wish to do so by entering an email address on the website and indicating their desire to receive direct marketing communications.

The buyer can opt out of offers and newsletters sent to the email at any time by notifying us via email or by following the instructions in the email containing the offers.


Dispute resolution

If the buyer has complaints regarding the Online Store, they must be sent to the email address info@skishop.ee or by calling +372 5151005

If the buyer and the Online Store cannot resolve the dispute by agreement, the buyer can turn to the Consumer Disputes Committee. You can familiarize yourself with the procedural terms and submit an application here. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the buyer and the Online Store. The examination of the buyer's complaint by the committee is free of charge.

  1. Scope and validity of terms

1.1 The terms apply to all legal relationships arising between all persons and the owner of the shopping environment skishop.kuutsemae.ee (hereinafter Rossignol e-store), Suusakeskuste AS (Suusakeskuste AS; Reg. code: 10211494, Arula village, Otepää rural municipality, 67411 Valgamaa), when purchasing products via the Rossignol e-store.

1.2 In addition to these terms, the legal relationships arising from the purchase of products via the Rossignol e-store are regulated by the legal acts in force in the Republic of Estonia.

1.3 Suusakeskuste AS is entitled to change and supplement these terms and the price list due to the development of the Rossignol e-store and in the interest of better and safer use of the e-store. Changes and additions to the terms and price list will be announced via the website skishop.kuutsemae.ee. Changes and additions to the terms and price list enter into force from the publication of the respective change or addition on the website skishop.kuutsemae.ee. If you submitted your order before the entry into force of the changes to the terms, the terms in effect at the time of your order submission apply to the legal relationship between you and Suusakeskuste AS, unless provided otherwise by law or these terms.

2. Prices

2.1. The prices of the Rossignol e-store apply in case of timely payment of the invoice according to what is specified in point 4.

2.2. All prices displayed in the Rossignol e-store are in euros and include the value-added tax in force in the Republic of Estonia.

2.3. Prices in the Rossignol e-store may differ from the prices of Rossignol products sold in retail stores.

3. Shopping cart and placing an order

3.1. You can change the number of products in the shopping cart. You can also change the ordered quantity of a product. By viewing the contents of your shopping cart, you can always go back to the e-store and choose more products.

3.2. After selecting the desired products, indicate the desired payment method and delivery method and click "Place Order". Now double-check whether all data are correct and click "Confirm Order". You will be directed to the payment page.

3.2. Enter the required data on the customer data page.

3.3. Be careful when filling in the fields on the customer data and order confirmation pages, as the quick and trouble-free delivery of the products you purchased depends on the accuracy and correctness of this information.

3.4. The sales contract for the products is considered concluded (Entry into force of the contract) from the moment the amount payable according to the order confirmation is received in the Suusakeskuste AS current account.

4. Payment for products

4.1. To make a payment, select your preferred payment method on the order placement page.

4.2. You can pay for the products:

4.2.1 via internet bank

4.2.2 with a credit card (Visa or MasterCard)

4.3. Your order will be cancelled if you have not paid the purchase amount within the prescribed time.

4.4. The order is processed and delivered upon 100% prepayment.

5. Delivery and handover of products

5.1. After the entry into force of the Contract according to point 3.4 of the Terms, the products will be delivered to you using the delivery term chosen by you.

5.2. Delivery of goods in stock within Estonia is generally 1-3 working days.

5.3. In the event that the product you ordered is not in stock and must be specially ordered from the supplier and it is evident that delivery of the product within the delivery deadline specified in the product description is not possible, and in other cases where timely delivery of the products is not possible due to circumstances for which Suusakeskuste AS is not responsible, we will notify you thereof via the contact phone or email address provided by you when placing the order within 2 working days from the entry into force of the Contract according to point 3.4 of the Terms. At the same time, we will inform you of the delivery deadline for the product you ordered. In the event that you lose interest in purchasing the product due to a longer delivery deadline, you have the right to cancel your order (see points 6.1. and 6.3. for more details) and the amount paid by you (including transport costs) will be refunded to you.

5.4. Once the products you ordered have been handed over to the courier company, the courier company will contact you in advance to specify the delivery time of the products.

5.5. The courier company will deliver the products to the address specified by you when placing the order. Subsequent changes to the destination are not possible.

5.6. When ordering goods to a parcel terminal, the code necessary for opening the parcel terminal will be sent to the phone number specified by you when placing the order.

5.7. Please monitor the accuracy of the contact details provided when placing the order to avoid delays and misunderstandings in the delivery of the products. Suusakeskuste AS and the courier company are not responsible for delivery delays and misunderstandings if the delay or misunderstanding is caused by the inaccuracy or incorrectness of the data provided by you when placing the order.

5.8. The products will be handed over to you by the courier together with a delivery note. Before signing the delivery note, we strongly recommend that you check the packaging of the products and, in case of external damage, make a corresponding note on the courier's delivery note. We ask you to report a product with damaged packaging to the email address skishop@kuutsemae.ee

5.9. When ordering goods to a parcel terminal, the maximum dimensions of the shipment can be: Post24 – 41x38x64 cm or SmartPOST – 60x36x60 cm.

6. Order cancellation and product return

6.1. You have the right to cancel your order after paying for the products but before the delivery of the products by sending a corresponding notice to the e-store address skishop@kuutsemae.ee together with the order number and your current account number.

6.2. After receiving the products, you have 14 days to familiarize yourself with the products. If the purchased goods do not suit you for any reason, you have the opportunity to return the product or exchange it for another product within 17 days by sending a corresponding notice to the email skishop@kuutsemae.ee together with the order number, your current account number, and the address where the products to be returned are located. Products made specifically for you are not subject to return.

6.3. In case of cancellation of the order as provided in point 6.1 or in case of withdrawal from the order as provided in point 6.2, the amount paid for the purchase will be refunded to you, from which the client bears the costs related to the shipping of the product (p. 6.5). We will transfer the money for the returned product back to your current account within 30 days at the latest from the arrival of the withdrawal notice to us, provided that you have returned the goods within the same period, except for the cases provided in points 6.4., 6.5, and 6.6 of these terms.

6.4. The returned product must be complete (include all items contained in the product packaging). If the product was purchased as part of a campaign where another product was added to the goods, you must return the entire set (i.e., all products).

6.5. The Rossignol e-store has the right to demand the full transport cost of the returned product from the client and deduct it from the refundable amount. In case the product was sent to the client free of charge, the transport price is calculated based on the actual price of the service provider.

6.6. If the returned product (and the product packaging) has deteriorated and the deterioration is caused by circumstances not due to Suusakeskuste AS, and as a result of non-purposeful use of the product, Suusakeskuste AS has the right to offset the decrease in the value of the product with the amount paid by you for the product and to be refunded to you. For offsetting, Suusakeskuste AS will send you a set-off notice to the email address provided by you when placing the order. In the event that you do not agree with the decrease in value shown in the set-off notice, you have the right to involve an independent expert to determine the decrease in the value of the product. Costs related to the expert assessment will be shared equally between you and Suusakeskuste AS, unless one party's position turns out to be clearly unjustified. In such a case, the costs related to the expert assessment will be borne by the party whose position turned out to be clearly unjustified.

7. Warranty and return of non-compliant products

7.1. Suusakeskuste AS is responsible for the non-compliance and defects of the products according to the Law of Obligations Act; the period for submitting claims is 2 years for private individuals and 6 months for legal entities from the moment of product delivery.

7.2. Suusakeskuste AS is not responsible for:

1) Deterioration/damage to the product through your fault.

2) Defects that have arisen as a result of improper use of the product.

3) Normal physical wear and tear of the product during normal use.

7.3. In the case of a product not conforming to the contract terms, Suusakeskuste AS undertakes to repair or replace the product with an equivalent product at its own expense. If the product can be repaired, replacement cannot be demanded, as this would cause unreasonable costs to the seller. Refund of money can only be demanded if replacement of the product within a reasonable time has not proven possible.

7.4. Warranty expert assessment is performed by Rossignol product specialists and at their expense.

7.5. If a client disputes the decision of Rossignol product specialists regarding a product warranty, they have the right to order an impartial expert assessment from a duly licensed institution. The costs of the expert assessment shall be borne by the party ordering it. In the event that the expert assessment proves the product is defective and Rossignol accepts the decision of the assessment, Rossignol shall cover the costs.

7.6. In the case of returning a non-conforming product, the amount paid for the product (including transport costs) shall be transferred to the bank account specified by you within 30 days at the latest, counting from the receipt of the notice of withdrawal from the order and the request to return the product.

7.7. The repair or replacement of a product during the warranty period does not extend the original warranty period.

7.8. A non-conforming product that has been compensated for will not be returned to the client.

7.9. If a product is not accepted for warranty and the person submitting the warranty claim does not demand the return of the product, Suusakeskuste AS has the right to dispose of the product after 30 days have passed.

7.10. In addition to the rights arising from the warranty, you also have other rights arising from the law.

7.11. In accordance with the Law of Obligations Act, the Buyer has the right to withdraw from the contract, which begins from the moment the product is handed over to the Buyer and is valid for 14 days. To exercise the right of withdrawal, a withdrawal application must be filled out and sent to the Seller, and the goods must be returned within 14 days. Upon the expiry of the withdrawal period, the client has the right to submit a claim by filing a corresponding application with the Seller.

8. Liability and force majeure

8.1. Suusakeskuste AS is liable to you, and you are liable to Suusakeskuste AS, for damage caused to the other party by breach of these terms and conditions in the cases and to the extent provided for by the legislation in force in the Republic of Estonia.

8.2. Suusakeskuste AS is not liable for damages caused to you or for a delay in the delivery of the product if the damage or the delay in delivery is caused by a circumstance that Suusakeskuste AS could not influence and the occurrence of which Suusakeskuste AS did not foresee and could not have foreseen (force majeure).

9. Other terms

9.1. All personal data of the client that has become known during the visit to the Rossignol e-store and the making of purchases is treated by Suusakeskuste AS as confidential information and will not be disclosed to third parties.

9.2. Issues not specifically addressed in these terms and conditions shall be governed by the legislation in force in the Republic of Estonia.

9.3. Disputes arising between you and Suusakeskuste AS in connection with the ordering and purchasing of products via the Rossignol e-store shall be resolved through negotiations. If an agreement is not reached, you have the right to contact the Consumer Protection and Technical Regulatory Authority or the Court to protect your rights. The resolution of disputes shall be based on the legislation in force in the Republic of Estonia.

10. Disclaimer

10.1. Product images are for illustrative purposes.

10.2. Product prices and availability may change without prior notice. In such a case, Suusakeskuste AS reserves the right to cancel the sale and return the money to the client's current account within 10 working days.

10.3. Suusakeskuste AS reserves the right to cancel the sale if any of the following problems have occurred with the product: a human error has occurred during price entry or a technical error in the system (for example, if a product costing 500 EUR is suddenly on sale for 50 EUR, it is clearly an error. Consequently, we assume that the client should understand that it is an error and the product is not for sale at such a price.)

10.4. Product information is checked and improved regularly. Data may have been updated after your last visit. Due to incomplete manufacturer data sheets, there may be inaccuracies in the product information of the Rossignol e-store. In such a case, the Rossignol e-store assumes no responsibility for the accuracy of product data. We still recommend checking the accuracy of the product information, if possible, before making a purchase by contacting our customer service email address skishop@kuutsemae.ee
