These Terms & Conditions govern purchases made through the online store skishop.ee (the “Online Store”).
The Online Store is operated by:

By placing an order through the Online Store, the customer confirms that they have reviewed and accepted these Terms & Conditions.
Nothing in these Terms & Conditions limits any mandatory rights granted to consumers under applicable Estonian or European Union law.
1. Scope and Definitions
These Terms & Conditions apply to contracts concluded between Suusakeskuste AS (“Ski Shop”, “we”, “us” or “Seller”) and customers purchasing goods through skishop.ee.
A Consumer means a natural person acting for purposes outside their business, trade or professional activity.
A Business Customer means a legal or natural person purchasing goods for purposes related to their business, trade or professional activity.
Consumer rights referred to in these Terms & Conditions apply only to Consumers unless expressly stated otherwise.
2. Products and Product Information
We make reasonable efforts to ensure that product descriptions, specifications, images, prices and availability displayed in the Online Store are accurate.
Product images are illustrative. Minor differences in colour, appearance, packaging or other non-essential characteristics may occur due to screen settings, manufacturer updates or other circumstances.
Technical specifications provided by manufacturers may be updated without prior notice.
The customer is responsible for selecting a product appropriate for their intended use, ability, measurements and requirements, except where the customer has reasonably relied on individual professional advice provided by us.
For technical sporting equipment, including skis, ski boots, snowboards and bindings, customers should contact us before ordering if they are uncertain about compatibility, size or suitability.
3. Prices
All prices displayed to Consumers in the Online Store include applicable VAT unless expressly stated otherwise.
Delivery charges and other applicable charges are displayed before the order is submitted.
We reserve the right to change prices at any time. A price change does not affect an order for which a binding sales contract has already been concluded, except in the case of an obvious pricing or technical error as described below.
4. Obvious Pricing and Technical Errors
Despite reasonable precautions, the Online Store may occasionally contain an obvious pricing, technical, data-entry or system error.
If the displayed price is clearly and objectively incorrect compared with the normal price or value of the product, or if another obvious technical error has occurred, we reserve the right to correct the error.
Where an order has been placed on the basis of such an obvious error, we will contact the customer as soon as reasonably possible.
Where permitted by applicable law, we may cancel an order affected by an obvious error and refund any payment already received.
This provision does not allow us to arbitrarily change an agreed price after a valid contract has been concluded.
5. Placing an Order and Formation of the Contract
To place an order, the customer selects the desired products, adds them to the shopping cart, selects the delivery and payment method and provides the information required to fulfil the order.
Before submitting the order, the customer has the opportunity to review the order and correct errors.
The customer is responsible for ensuring that the information provided when placing an order is accurate and complete.
After the order has been submitted, the customer will receive an electronic confirmation.
Where applicable law permits, an automatically generated acknowledgement that an order has been received does not prevent us from rejecting an order where there is a legitimate reason to do so, including an obvious pricing error, lack of stock, suspected fraud, legal restrictions or inability to fulfil the order.
If we cannot fulfil an order for which payment has already been received, the relevant payment will be refunded.
6. Payment
The customer may pay using the payment methods made available at checkout.
Payment transactions may be processed by independent payment service providers.
The Seller does not necessarily receive or store the customer's complete payment card information.
The customer is responsible for ensuring that they are authorised to use the selected payment method.
An order may be held or cancelled where payment is unsuccessful, reversed or reasonably suspected to be fraudulent.
7. Delivery
Orders are delivered using the delivery methods offered at checkout.
The currently available delivery options, prices and estimated delivery times are displayed in the Online Store.
Delivery times are estimates unless expressly agreed otherwise.
The customer is responsible for providing correct delivery information, including the recipient's name, telephone number, delivery address and/or selected parcel terminal.
We are not responsible for delays or additional costs caused by incorrect or incomplete information provided by the customer.
Where a shipment is returned to us because the customer failed to collect it, provided incorrect delivery information or otherwise prevented delivery, we may require the customer to pay reasonable additional delivery costs before resending the order, insofar as permitted by law.
Failure to collect a parcel does not by itself constitute a valid notice of withdrawal. A Consumer wishing to exercise the statutory right of withdrawal should notify us clearly of that decision.
8. Transfer of Risk
For Consumers, the risk of accidental loss or damage to the goods transfers in accordance with mandatory consumer law.
Where a Consumer independently commissions a carrier not offered by us, the rules governing transfer of risk may differ as provided by applicable law.
Different arrangements may be agreed with Business Customers.
9. Inspection Upon Delivery
Customers are encouraged to inspect the shipment promptly after receiving it.
If the external packaging shows visible damage, we recommend documenting the damage, including with photographs where appropriate, and notifying the carrier and us as soon as reasonably possible.
Failure to notify us immediately does not remove any mandatory statutory rights of a Consumer.
10. Consumer's 14-Day Right of Withdrawal
A Consumer purchasing goods online generally has the right to withdraw from the contract without giving a reason within 14 days.
For goods, the withdrawal period generally begins on the day on which the Consumer, or a third party designated by the Consumer other than the carrier, receives physical possession of the goods.
To exercise the right of withdrawal, the Consumer must notify us of their decision within the applicable withdrawal period by means of a clear statement or by using the withdrawal functionality or model withdrawal form made available by us.
Contact:
After notifying us of withdrawal, the Consumer must return the goods without undue delay and no later than 14 days after communicating the withdrawal.
Detailed instructions are set out in our Returns & Refunds Policy.
11. Return Costs
When exercising the statutory right of withdrawal, the Consumer bears the direct cost of returning the goods unless:
- we have expressly agreed to bear the cost;
- the goods are defective, incorrect or otherwise non-conforming and applicable law requires us to bear the relevant cost; or
- applicable mandatory law provides otherwise.
For oversized products, including certain skis or other sporting equipment, return shipping costs may be higher than standard parcel delivery costs.
12. Condition of Goods and Diminished Value
A Consumer may inspect and handle goods to the extent necessary to establish their nature, characteristics and functionality, comparable to what would reasonably be permitted in a physical shop.
The Consumer is responsible for any diminished value resulting from handling beyond what is necessary for that purpose, where provided by applicable law.
Examples may include, depending on the circumstances:
- wearing footwear or ski boots outdoors;
- skiing or snowboarding with the product;
- visible scratches, dirt, wear or damage;
- removing protective elements where this is not necessary for inspection;
- using clothing beyond normal fitting;
- damaging or unnecessarily disposing of packaging where this causes a demonstrable reduction in the value of the product;
- modifying or adjusting equipment beyond what is reasonably necessary for inspection.
Any deduction or claim relating to diminished value will be based on the actual circumstances and reduction in value of the returned product.
13. Ski Boots, Footwear and Clothing
Ski boots, footwear and clothing should be tried on indoors and on a clean surface.
A Consumer may try on such products as reasonably necessary to assess fit, size and basic suitability.
Outdoor use, skiing, walking outdoors, substantial wear, heat moulding or other modification may result in diminished value.
Nothing in this section excludes mandatory Consumer rights.
14. Skis, Snowboards, Bindings and Technical Equipment
Technical sporting equipment must be selected, installed, adjusted and used appropriately.
The customer is responsible for providing accurate information requested for installation or adjustment, including, where applicable:
- skier or rider information;
- boot model and boot sole length (BSL);
- weight;
- height;
- age;
- ability level;
- intended use;
- other measurements or technical information reasonably required for the service.
The customer must not knowingly provide inaccurate information.
Binding Installation and Adjustment
Binding installation, drilling, mounting or permanent adjustment can alter a product in a way that cannot be fully reversed.
Where we perform installation or adjustment according to the customer's specifications, the effect of that work on any right of withdrawal will be determined in accordance with applicable mandatory law.
Nothing in these Terms automatically removes a Consumer's statutory right of withdrawal merely because bindings have been installed.
However, where the work or the customer's handling results in an actual reduction in the value of the product, we reserve the right to claim compensation for diminished value to the extent permitted by law.
Where a product is genuinely made to the customer's specifications or clearly personalised, the statutory exceptions to the right of withdrawal may apply.
15. Professional Installation and Safety
Certain sporting equipment requires professional installation, adjustment, inspection and maintenance.
Bindings and other safety-critical equipment should be installed and adjusted by a suitably qualified technician in accordance with the manufacturer's requirements.
Customers must follow the manufacturer's instructions and warnings.
The Seller is not responsible for damage resulting solely from improper installation, adjustment, modification, maintenance or use carried out by the customer or an unrelated third party, except where liability cannot legally be excluded.
Nothing in this clause excludes liability for defective goods, defective services, negligence or other liability that cannot be excluded under applicable law.
16. Customised and Personalised Products
The statutory right of withdrawal may not apply to goods that are made to the Consumer's specifications or clearly personalised, where the applicable statutory exception is satisfied.
The customer will be informed where an order is treated as a customised or personalised product for which the statutory withdrawal exception applies.
A standard product does not become non-returnable merely because the Seller describes it as a special order.
17. Sale, Outlet and Discounted Products
A reduced price, sale price or outlet classification does not by itself remove a Consumer's statutory right of withdrawal or rights relating to non-conforming goods.
Any statutory exception will apply only where the requirements of that exception are satisfied.
18. Non-Conforming and Defective Goods
Consumers have statutory rights where goods do not conform to the sales contract.
These rights are separate from the 14-day right of withdrawal.
If a customer believes that a product is defective or non-conforming, they should contact:
The customer should provide the order details, a description of the issue and, where reasonably useful, photographs or other evidence enabling us to assess the claim.
We may request an opportunity to inspect the product before determining the appropriate remedy.
Claims are handled in accordance with applicable Estonian consumer law.
19. Normal Wear and Misuse
A product is not necessarily defective merely because it shows deterioration resulting from:
- normal wear and tear;
- an accident or impact;
- incorrect use;
- use contrary to the manufacturer's instructions;
- improper storage;
- lack of reasonable maintenance;
- unauthorised modification or repair;
- incorrect installation by the customer or an unrelated third party;
- use of incompatible equipment or components.
This provision does not affect the customer's rights where the underlying cause is a defect or lack of conformity for which the Seller is legally responsible.
20. Manufacturer Warranties
Some products may be covered by a voluntary manufacturer's commercial warranty.
Any manufacturer's warranty is additional to, and does not replace or restrict, mandatory statutory Consumer rights against the Seller.
The scope and conditions of a manufacturer's warranty are determined by the relevant warranty terms.
21. Refunds Following Withdrawal
Where a Consumer validly withdraws from the contract, we will refund payments as required by applicable law, including the cost of the least expensive standard delivery option offered by us where applicable.
Additional delivery costs resulting from the Consumer choosing a more expensive delivery method do not have to be refunded beyond the cost of the standard delivery option.
We may withhold reimbursement until we have received the returned goods or the Consumer provides evidence of having sent them back, whichever occurs first, where permitted by law.
Refunds are normally made using the same means of payment used for the original transaction unless otherwise agreed.
22. Exchanges
Unless expressly offered otherwise, we do not operate an automatic exchange service.
A customer wishing to purchase another size, colour or model should return the original eligible product and place a new order.
23. Business Customers
Mandatory statutory Consumer protections, including the statutory 14-day distance-selling right of withdrawal, do not automatically apply to Business Customers.
Returns by Business Customers are accepted only where:
- agreed by us in advance;
- provided for in a separate agreement; or
- required by applicable law.
Unless mandatory law provides otherwise, commercial terms agreed separately with a Business Customer take precedence over these Terms & Conditions to the extent of any conflict.
24. Limitation of Liability
We are liable in accordance with applicable law.
To the maximum extent permitted by law, we are not responsible for indirect loss resulting solely from circumstances outside our reasonable control or from misuse of products.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including mandatory liability for injury, intentional conduct or other non-excludable liability.
25. Force Majeure
We are not liable for a failure or delay in performance caused by circumstances beyond our reasonable control to the extent recognised by applicable law.
Such circumstances may include serious transport disruptions, natural events, widespread infrastructure or communications failures, governmental restrictions or other comparable events.
We will take reasonable steps to minimise the effects of such circumstances.
26. Intellectual Property
Content available through skishop.ee, including text, photographs, graphics, logos and website materials, may be protected by intellectual property rights.
Customers may use website content for ordinary personal purposes connected with shopping but may not reproduce or commercially exploit protected content without the permission of the relevant rights holder.
27. Personal Data
Personal data is processed in accordance with our Privacy Policy and applicable data protection legislation.
Where cookies or similar technologies require consent, further information is provided in our Cookie Policy and cookie settings.
28. Amendments to These Terms
We may amend these Terms & Conditions from time to time, including to reflect changes in law, our services or business practices.
The version applicable to an order is generally the version made available to the customer at the time the order is placed.
Changes do not retroactively alter an already concluded contract unless required by law or expressly agreed with the customer.
29. Governing Law
These Terms & Conditions and contracts concluded through the Online Store are governed by Estonian law.
For Consumers residing in another European Union country, this choice of law does not deprive them of mandatory consumer protection rights that apply under applicable law.
30. Complaints and Dispute Resolution
We encourage customers to contact us first so that we can attempt to resolve any issue directly.
Complaints may be submitted to:
Suusakeskuste AS
Email: skishop@skishop.ee
A Consumer may also have the right to submit a dispute to the competent consumer dispute resolution body in Estonia.
Nothing in these Terms limits either party's right to seek remedies before a competent court.
31. Severability
If any provision of these Terms & Conditions is found to be invalid or unenforceable, this does not automatically affect the validity of the remaining provisions.
The invalid provision will apply only to the maximum extent permitted by applicable law.
